The rules for using this website. Our products and client services have their own terms or agreements.
Agreement to these terms
These Terms of Use ("Terms") govern your access to and use of the website ozumni.com and its pages (the "Site"), operated by Ozumni LLC ("Ozumni", "we", "us"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms cover the Site only. Ozumni products and any services we provide to clients are governed by their own terms or by a separate written agreement.
Using the Site
You may use the Site for lawful purposes to learn about Ozumni and to contact us. You agree not to:
- use the Site in violation of any law or regulation;
- try to gain unauthorized access to the Site, its servers or any related systems, or interfere with their operation;
- send spam, malware or any content that is unlawful, misleading or infringes the rights of others;
- copy, scrape or harvest content or personal information from the Site by automated means without our written permission;
- impersonate any person or misrepresent your affiliation with any person or company.
Our content and trademarks
The Site and its content, including text, graphics, illustrations, the Ozumni name and logo and the design of the Site, are owned by Ozumni or its licensors and are protected by copyright, trademark and other laws. You may view and print pages for your own information. Any other use requires our prior written permission.
Some 3D models and other materials on the Site are used under licenses from third parties. Those materials remain the property of their owners. The following models are used under Creative Commons Attribution licenses and were recolored to match the Site:
- “Low-poly Airplane” by MaX3Dd (Sketchfab), licensed under CC BY 4.0. Changes: recolored.
- “very cute airplane” by Akash Rudra (Poly Pizza), licensed under CC BY 3.0. Changes: recolored, landing gear removed.
What you send us
When you send us a message, brief, application or other material through the Site, you confirm that you have the right to share it and that it is accurate. Please do not send confidential information or trade secrets through the Site: sending a message does not create a confidential relationship, a client relationship or any obligation for us to respond, start work or enter into an agreement. Any project, partnership or investment requires a separate written agreement signed by both sides.
If you send us ideas or feedback about Ozumni or our products, you agree that we may use them without restriction or compensation to you.
We handle personal information in your submissions as described in our Privacy Policy.
No offer of securities
Nothing on the Site is an offer to sell, or a solicitation of an offer to buy, any securities or interests in Ozumni or any of its products. Any such offer will be made only through definitive documents to qualified persons and in compliance with applicable securities laws. Information on the Site is provided for general purposes and is not investment, legal or tax advice.
Third-party sites and services
The Site may link to or load content from third-party websites and services. We do not control them and are not responsible for their content, policies or practices. Your use of them is at your own risk and subject to their terms.
Disclaimers
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components, or that its content is complete or current. Illustrations on the Site are abstract and use sample data.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OZUMNI AND ITS MEMBERS, MANAGERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS (US $100). Some jurisdictions do not allow these limitations, so they may not apply to you in full.
Indemnification
You agree to indemnify and hold harmless Ozumni and its members, managers, employees and agents from any claims, damages and expenses, including reasonable attorneys' fees, arising from your misuse of the Site or your violation of these Terms.
Governing law and disputes
These Terms are governed by the laws of the State of Colorado and applicable US federal law, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in the City and County of Denver, Colorado, and you and Ozumni consent to their jurisdiction.
Changes to these Terms
We may update these Terms from time to time by posting a new version on the Site and changing the "Last updated" date. The updated Terms apply from the moment they are posted. If you keep using the Site after that, you accept the updated Terms.
General
If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce any provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and Ozumni about the Site.
